Why We are Facing Violence and Rape in West Bengal?

WEST Bengal now stands out among the states in terms of atrocities against women. National Commission for Women had to intervene more than once and was forced to visit the state. There is a strong association between increased violence against women in the state and the rule of Trinamul Congress after 2011. Immediately after the party came to power in May 2011, atrocities against women began to rise. This association cannot be seen as accidental, there is a politics behind this association. During the 34 years of Left Front rule, the state was never in this kind of miserable situation. It is not to say that there were no incidents of violence against women under Left Front regime. But never such daily attacks on women took place then. Also, the culprits were punished whenever the incidents occurred and the victims along with their families did not have to live under threats even after the acts of violence. The culprits were also not protected by the ruling party, claiming to be their party men. There is no single state in the country now where the culprits are moving around and the victims are under threats. Even if cases of violence are taking place in the country as a whole, what is happening in West Bengal currently is unheard of anywhere.



BRUTAL INCIDENTS
In Madhyamgram, a young girl of a migrant family from Bihar was raped and when she was coming home after lodging complaint with the police, she was raped for the second time. The culprits were arrested but the victim’s family was attacked by Trinamul Congress goons and the victim’s family fled to a different place, fearing further attacks. But in a shocking manner the girl was torched to death before the identification of perpetrators process began. The police tried to hush up the case by taking away the dead body while the girl’s parents were surrounded by Trinamul Congress antisocials. Brutality to this extent is still unheard in any part of India.

In Labhpur, a tribal girl was gang raped on the verdict of a kangaroo court in a village. The kangaroo court was allegedly attended by Trinamul Congress representatives. In Amta, Trinamul Congress goons attacked a village and the CPI(M) activists and supporters were evicted out of the village. Only women were left behind. Later they disconnected power supply and in a most gruesome incident ever heard, they raped two of a family in the dark and ransacked the house. Such incidents are occurring each and every day across the state.

CRIMINALS IN POWER
The question arises why are such incidents of violence against women taking place in West Bengal? It is now clear to all that Trinamul Congress has directly given shelter to the criminals and has won the polls with their help. They are running the state government also with their help. So the criminals will have to be given freedom in the state. They are also to be used for keeping the people obedient under the control of the party. The party without any political ideology, without any vision to work towards the welfare of the people is only trying to silence people’s voices. For this they need the help of the criminals and lumpens in the state. The alliance between Trinamul Congress and lumpens is for mutual benefit. TMC needs criminals to frighten and silence people’s voices and criminals need them for shelter. However, the process is not easy in a state like West Bengal, which has been under Left Front regime for more than three decades.

The Left Front rule in the state had brought in consciousness about one’s rights. Poor people of the state had learnt to live with dignity. Peasant families in the rural areas obtained land under Operation Barga. People in the state became empowered through welfare programmes and decentralised three-tier panchayats and municipalities developmental activity. Even if they voted for TMC in the past assembly elections, it is not possible for them to become submissive to TMC rule in the state. They have learnt to question and critique, which is not being allowed under present TMC rule.

PROGRESS OF WOMEN UNDER LF
One of the major problems for this sort of jungle raj in the state  has been the opposition of women in the state. Women have progressed much under the earlier Left Front regime. Female literacy gained. Juvenile sex ratio improved much during the last two decades. They became aware of their right to education and health. Women also got their right to land through joint patta system. Girl’s education in the state reached high. Thousands and lakhs of girls now pass out from schools, colleges and universities each year. The public examination results show how the girls from poor families in the districts are faring better in the examinations each year. There has been seat reservation for women in the panchayats and women were used to running panchayats and municipalities. Over 23 lakhs of Self Help Groups were registered under Left Front rule. It is difficult to convert this women population into docile followers. There exists a glass ceiling for women everywhere. Though not visible in terms of legislations, this glass ceiling is a social construct. What is expected out of a gender sensitive State is pushing up the glass ceiling as far as possible to yield women of the country more space day by day. This was done by the Left Front government in West Bengal. Throughout the last three decades women have become more and more independent, more and more active in the state. Young girls aspire to be educated and working. Education, political participation and work have made women of the state to cross the gender-class barriers in the society. Before the coming of Left Front in 1977, the generation of women who did not dream to go to college now sent their daughters to be educated in colleges and universities.

West Bengal was one of the states that were pioneers in reservation of thirty-three percent of seats in panchayats and municipalities for women. Experience of political empowerment of women in the state has been remarkable. There were all-women panchayats where the entire panchayat was run by only women. In the initial year of reservation, Kultikri was one such panchayat. Women were participating actively in the process of development. Women panchayat representatives along with other women in the villages were all gaining empowerment in the process. Women were part of political process and they were taking part in political movements in the state. This has enabled the state to raise the level of women’s seats to more than 42 per cent in the natural way. Leadership emerged among women in the process. After this experience, it was difficult for TMC to convert women into submissive crowds who will only praise TMC chief minister without asking questions.

Left Front in its last state budget also expressed priority spending on women’s welfare, particularly welfare of scheduled caste, scheduled tribe and minority women. The priority was in setting up schools, colleges everywhere and the number of girl students were increasing. Women self-help groups were tied to the welfare schemes of women and children and the child development units. Monthly allowances of Anganwadi and health workers were also increased. In 2010-11 itself, which is the last year of Left Front rule, Rs 10,468 lakh were spent for development of 22 lakh self help groups. After TMC regime this was reduced to Rs 6902 lakh. Self-help groups were dismantled, and in its place microfinance institutions and chit funds were promoted by the present state government. These women may have voted for TMC in the last polls, but it is not possible for them to submit to the rule, which was a hurdle before the TMC.

VIOLENCE & RAPE AS INSTRUMENTS
Violence and rape were taken up as instruments to make women as well as men submissive. A fascist party wants clear submissive voters and if they are not so, they had to be converted to submissive forces. Rape and violence are also instruments to silence the voices of men also. The message is to be given that they cannot protect their women. Only this weapon can surely bring them to submission. To execute this weapon they need lumpens and anti-socials who are already their allies. There has to be unrestricted lumpenisation to covert people into submissive mobs to the fascist regime. If they submit to the lumpens, they will submit to the TMC party. Women who have been already pampered by the earlier Left Front regime had to be moved indoors. Rape has always acted as a weapon to push women indoors. This happened against minority women in Gujarat riots steered by Modi, unfortunately projected as prime ministerial candidate by the BJP.

The same tactics were taken up by TMC in Bengal. Most of the rapes that took place in Bengal in recent times are gang rapes. Gang rapes are organised crimes, which are conducted by organised lumpens who chalk out and execute the crime. This has happened in Park Street, Katwa, Kamduni, Madhyamgram, Amta and all other places. The culprits are more than one in all the cases. This also records complete breakdown of law and order so that the culprits are getting the opportunity to organise and execute. Without the pampering of the state administration there cannot be consecutive gang rapes held one after another in the state. The ruling party is keen to resist women’s liberation in the state. Women’s liberation is not to be there. It is not to be allowed that women are taking decisions. If they do so, they will learn to question and protest. TMC cannot allow that. Women and men are to be taught a lesson that they are vulnerable. Rape is an instrument to do so.  This is the reason why Anganwadi workers CPI(M) activists, AIDWA activists are most targeted for rape and violence. Most of the culprits in all the cases are TMC men and protected by TMC government. Culprits are generally set free. After the barbarous Kamduni incident of rape and murder, culprits are yet to be punished. West Bengal has been turned into the unsafe place for women in the country. Women are to be turned indoors, this is the goal of TMC. But how will a government plan to survive if they pursue this policy? They also have policies for women. They launched a policy Kanyasri of providing education to girls. Whatever can be done will come out of women looked as targets or beneficiaries of development policy of the State. Policies should not be such which will enable them to be empowered themselves. Most of the victims are disabled, most of the victims are poor, most of the victims are coming from backward community, and most of the victims are underprivileged.

However, this is not being tolerated any more in the state. Women, men of the affected families, people of all sections, students, youth, and employees are all getting organised. Mammoth protest rallies are being held regularly in the state against such assaults and violence, rape against women. Trinamul Congress also is watching this but is failing to estimate the repercussions of all such anger, grief and protest of the people.

PB ON WEST BENGAL SITUATION

NEW DELHI: The Polit Bureau of the Communist Party of India (Marxist) met in New Delhi on January 21 and 22, 2014. It has issued the following statement on West Bengal:

The Polit Bureau expresses serious concern at the number of gang-rapes and crimes against women in West Bengal. This has been exemplified by the horrific double gang rape of a sixteen year old girl at Madhyamgram and her subsequent murder. West Bengal has registered the highest number of crimes against women in the country in the years 2011-12.

The Polit Bureau condemned the callous attitude and the failure of the Trinamul Congress government to take swift action against the culprits and effective steps to curb such crimes against women.

The ruling TMC continues with its rampage against democratic rights. All elected bodies and institutions are being subverted. Currently elections are being held to the college unions. Out of the 222 college union elections held so far, in most of them students of organisations opposed to the ruling party’s student organisation were not allowed to file nominations. Only in 36 colleges were they able to do so partially.

The Polit Bureau strongly condemned the murder of Saifuddin Mollah, a 25 year old SFI leader who was brutally beaten to death by TMC goons in Baruipur in South 24 Parganas.


Given the notorious record of the ruling party in rigging elections and preventing voters from casting their votes, the Election Commission should take special measures to ensure a fair and peaceful election.

BRUTALITY & RESISTANCE IN KOLKATA

On Orders, Police Practically Played Goons: CPI(M)

IT was a murder most foul. It was a protest most heart rending.

Kolkata erupted in protest on the first day of the New Year after a girl, twice gangraped and then burnt to death, breathed her last in a city hospital. The episode, as if taken from a horror film, exposed the cruelty of a regime that is ruling West Bengal now.

The girl, daughter of a taxi driver, came with her parents from Samastipur, Bihar, to Kolkata with the hope that her life would change for the better. But that was not to be. She was only 16 years old. She was first gangraped on October 25 in Madhyamgram, a crowded northern suburb of Kolkata in North 24 Parganas district. As she and her parents were coming back after lodging the complaint with the police, she was kidnapped along the way and tortured again by the same gang of anti-socials. It was horrible enough under normal circumstances, but Ms Mamata Banerjee’s West Bengal has ceased to be a normal state. The perpetrators were goons sheltered by the ruling Trinamul Congress (TMC) and they repeatedly threatened, harassed and humiliated her family. Under pressure from the local people and the women’s organisations in particular, the police was forced to arrest six of the culprits.

The threat of dire consequences, however, continued through the ruling party’s local activists. The poor taxi driver had to leave the place and hire a home in the airport locality. But the friends of the culprits, through the TMC network, got the address of the new shelter and harassment again started. The family was pressurised to withdraw the case. Or, as has been proved by now, the planning was to annihilate the main witness of the crime --- the girl herself.

On December 23, a group of hooligans raided the house when both of her parents were outside. An altercation followed. Soon after, fire was seen from the house and her neighbours rushed in. Meanwhile, her mother also rushed back. The girl was heard shouting, “Mother, they will not allow us to live. You come along with me; Oh, my mother!”

The girl was admitted to R G Kar Hospital with more than 70 percent burn injuries. Earlier, it was told that she had tried to commit suicide in the face of continuous harassment. But finally it was learnt that she was put on fire by the goons. On December 31, 2013, she lost the battle and died.

This was thus a clear case of murder ---premeditated, most foul, in cold blood.





The girl, in her dying statement, told the police that the same men who had allegedly raped her, had set her ablaze. This was admitted by the police after three days --- in the face of a strong public opinion and steadfastness of the girl’s father.

"In her dying declaration before Dr Sudipta Singh and investigating officer Saidullah Sana at the R G Kar hospital, she said two persons, who were co-accused in the rape case, set her on fire," said additional deputy commissioner (airport division), Nimbala Santosh Uttamrao, on the day of the funeral. He said the police have now added the murder charge to the case.

The girl’s father also said the accused tried to burn her alive because she had complained against them. He was upset, however, because “the police sat over her dying statement and did not book the accused for murder.” Her father said she was set afire on December 23 at the rented house in the airport area where the family was forced to shift from Madhyamgram after threats by the accused.

It is alleged that even in the state run R G Kar hospital, the girl was not treated in any proper manner. Continuous request to refer her to SSKM Hospital, having a modern burn unit, was refused. It seemed that some forces from the high up were working behind the scene.

The ordeal did not end with the death either. After spontaneous protests around the hospital and road blockades, the girl’s body was taken to her house. It was announced that the body would be kept in a mortuary and a funeral rally will take place on January 1. The Taximen’s Union, affiliated to the CITU, had called the rally and decided that it would march towards Raj Bhavan, the governor’s house. But the police perpetrated a nasty, uncivilised attack when the body was on its way to mortuary. Police jeeps cordoned the hearse and forcefully took the body to the crematorium. However, this unlawful act proved futile as the parents of the girl refused to accompany the police and refused to hand over the death certificate. The body was kept for eight hours in the crematorium, cordoned by the police, and the whole state witnessed through news channels the inhuman behaviour of the state administration on the eve of the New Year.

Meanwhile, another gruesome episode unfolded in the girl’s house. District police officials, including the police superintendent, raided the house. They threatened the girl’s father with dire consequences if they did not hand over the death certificate. Local TMC hooligans accompanied the police and gheraoed the house. "The police officials threatened me and asked me to leave the state and return to Bihar with the body. The police officials and some local toughs also threatened that if I did not, they would stop me from driving my taxi," said the victim's father to the media. He even reported that the police officers threatened to kill him by firing. The parents reported their ordeal to the governor, M K Narayanan, on January 1.

But all these terror tactics failed because of resolute determination of a working class family who refused to let her daughter get a grotesque farewell. The police was forced to bring the body back to the house. The police then accompanied the parents to the crematorium again, in the early hours of the morning, with the intention that everything should be ‘hushed up’ before the people become alert. But again, their design was foiled by the girl’s father. He insisted that the body would have to be taken to the CITU office first. The news spread and people began to gather in front of the crematorium. CITU leaders, including Shyamal Chakraborty and Dipak Dasgupta, and AIDWA leaders also rushed there and after a brief clash with the police the body was taken to the CITU state office. 

The body was kept there and thousands gathered to pay their respect --- in fact their last love to a sister who suffered a brutal death. Workers, students, youths, women, intellectuals assembled and patiently waited. Finally, the rally started with small congested steps from the West Bengal state office of the CITU at around 4 p m and then every confident footsteps of this huge procession made her reborn every single moment they marched. The procession ended at the Esplanade. Then she was taken to the crematorium, with her parents and near and dear ones accompanying her through this span of the journey. But the stretch from the CITU office to the Esplanade made many feel so deeply like her parents, brothers and sisters that they refused to leave her half the way. They are all determined to make her win in this battle of justice and dignity now. The rally was silent, but the anger reverberated in the sky of the New Year. 

The leader of the opposition in the assembly, Suryakanta Mishra, while participating in the rally, said, "Soon after Tuesday night’s incident when police held up the body and tormented the victim’s family, I had a word with the home secretary. I told him that instead of standing beside the victim’s family, the police are practically playing the role of goons," Mishra said.

"We believe that without orders from the top the police could not have acted the way they did. The police are even trying to downplay the incident, as is evident from the fact that they registered the second rape complaint as molestation. What is striking is the silence of the chief minister on the issue. She only gave her wishes for the New Year but conveniently sidestepped the brutal incident," Mishra added.

"The victim did not receive proper treatment in hospital. The health department should be held accountable for the death. The goons wanted to burn her alive and the police wanted to cremate her body despite objections from the family. Such activities are only encouraging the criminals," said CPI(M) state secretary Biman Basu.

West Bengal: Criminals’ Own Country

State Records Highest Growth in Crimes in Two Years 


WHATEVER happens to economic growth, West Bengal has achieved the highest growth rate of crime in the whole country. And this too in just two years! This grand success has been recognised by the Crime in India, 2012 report compiled by the National Crime Records Bureau (NCRB) that comes under the union ministry of home affairs. The report has also exposed that the state, under Trinamul regime, ranked first in the matter of crimes against woman for consecutive two years.

The NCRB report showed the incidence of total cognisable crimes in the states and union territories during 2007-2011, the quinquennial average of these five years, and the numbers in 2012. It also calculated the percentage change in 2012 over the said average. It showed that in West Bengal the overall incidence of crimes has increased by a whopping 41.6 per cent over the 2007-11 average. This is the highest increase in the whole country, while the average growth rate in crimes is 11.2 per cent for the country as a whole. Nearest to West Bengal is Assam with 37.6 per cent increase, while in Kerala it is 20.8 per cent. The rate of increase in the corresponding period was 15 per cent in UP, 19.2 per cent in Odisha and 6.2 per cent in Andhra Pradesh. West Bengal experienced an increase of 12.7 per cent over the 2011 figure.

The time period of this unprecedented growth of crime is exactly the same as that of the TMC rule in the state. Significantly, the period of 2007-11 witnessed widespread Maoist violence in three districts of West Bengal, and the anarchy and violence spearheaded by the then opposition during the Singur-Nandigram agitations, resulting in an increase in IPC crimes. But these components were absent in 2011 and 2012. Even then the unparalleled growth rate of crime points to an increasing dominance of criminals and anti-social elements in the society in West Bengal. Buddhadeb Bhattacharjee has often commented that criminals in West Bengal were now feeling that the government was theirs. The NCRB report has now proved him correct.

West Bengal, once the safest place for women, has turned into a horror place for them in the last two years. That this is not an overstatement has well been proved by the NCRB data. It shows that in 2011 the registered cases of crime against women in the state were 29,133. Then these increased to 30,942 in 2012, making the state Numero Uno again. West Bengal accounted for 12.7 per cent of the total number of crimes against women in India. For Andhra Pradesh the figure is 28,171 and for UP 23,579.

True the incidence of rape in the state dropped to 2,046 in 2012 from 2,363 in 2011. However, cases of kidnapping and abduction increased to 4,168 in 2012 from 3,711 in 2011. “Assault on women with intent to outrage their modesty” has also shown an increase to 3,345 in 2012 from 2,363 in 2011. Insult to modesty accounted for 556 registered cases in 2012.


It should be noted here that the state government has practically stopped sending details to the NCRB for the few months now. But even the truncated version has exposed the kind of rule that the first woman chief minister of West Bengal has created in the state.

The state administration in is no mood to look at the facts. State director general of police, Naparajit Mukherjee, contested the NCRB statistics, saying the rape incidents had come down "considerably." He said this in a media conference just after two consecutive incidents of murder after mass rape took place in North 24 Parganas and Nadia. In these cases, two girl students were killed after rape.

Opposition leader Suryakanta Misra has termed the lack of concern on the part of the state administration on the deteriorating law and order situation as the most serious source of concern. Taking a dig at the DGP, Mishra said: "He is talking like his master's voice." He accused the Mamata Banerjee government of using the police as well as the administration "shamelessly" in its interest. The CPI(M) leader also contested the government's view that recording of crimes against women had increased during its rule. "There is no scope for reporting of crimes at police stations across the state even in case of crimes against women," Mishra commented.

Anti-Women Atrocities on Rise in Bengal

ON March 19 a delegation of the All India Democratic Women’s Association (AIDWA) met the chairperson of the National Commission for Women (NCW) at New Delhi and submitted to her a memorandum about the spate of attacks on women that have occurred in West Bengal in the last seven to eight months. They also expressed concern over the attitude of the state government towards these attacks, Even the West Bengal chief minister has been making statements questioning the veracity of the victims’ statements, the delegation pointed out.

Describing these attacks as cases of political vendetta, the delegation of the All India Democratic Women's Association said these incidents of atrocities against women are on the rise. So far, 23 women have been raped, 513 women molested and 757 women physically assaulted in the state by anti-socials allegedly associated with the ruling Trinamul Congress (TMC) party. In addition to this, there is an exponential increase in cases of rape and molestation of women having no political association whatsoever. Unfortunately, the AIDWA memorandum said, “their complaints have been discredited even before any investigation could be conducted, by people in positions of authority who have alleged that these reports were fabricated and were part of a conspiracy to denigrate the government.”

The memorandum quoted some examples of this trend. On February 5, 2012, a woman was gangraped in Kolkata, in a car. When she was able to overcome her trauma and fear, she went to lodge a police complaint on February 9 but was humiliated by the policemen present. When she approached the senior police officials and an enquiry was ordered by the Joint Commissioner of Police (Crime), the chief minister, the police commissioner and a cabinet minister publicly stated that her story was fabricated and politically motivated. This was despite the fact that the police found prima facie evidence in support of her allegations. Such statements do not augur well as far as justice for the victim is concerned, the AIDWA said.

In another incident that took place on February 25, 2012, a gang armed with choppers and firearms looted the passengers of a train at Admadpur Katwa in Bardhman. A woman who resisted was dragged out of the train and raped. Once again the chief minister, however, accused the woman victim of concocting a story for political motives. The chief minister even went to the extent of saying that the victim’s husband was from the CPI(M). But the truth is that she is a widow whose husband died 11 years ago, and neither of them had had any political affiliations. In this case too, investigations have corroborated her complaint, but earlier fears of inaction have been strengthened.

The AIDWA memorandum quoted some more cases. These included the rape of a deaf and dumb girl at Bankura government hospital by a junior doctor on February 27, 2012;  the rape of a five year old girl child on February 29, 2012 by a TMC worker Sudhanshu Mondol in Namkhana Block of South 24 Paraganas; the rape of an Adivasi agricultural labourer by anti-socials near Seuri in Birbhum on February 27, 2012; the rape and murder of Munia Devi Das of Howrah Bally on February 24, 2012; the rape of an Adivasi daily wage earner at Chandrakona in Jangalmahal on March 10, 2012 etc. The AIDWA pointed out that “This spate of atrocities has created conditions of insecurity for women in the state.”

The organisation further said that after the assembly elections, workers of the Integrated Child Development Scheme (ICDS) have been facing brutal attacks by TMC goons. Many centres are being forcibly closed down. Anganwadi workers are being forcibly prevented from attending the centre, and many have been forced to leave their villages. Those who do no evacuate are being penalised with fines ranging from Rs 20,000 to Rs 2,00,000. Those who have bravely opened the centres despite the threat have been molested and assaulted. In North 24 Parganas, an Anganwadi Sahayika, Bakuli Sardar, was shot dead by TMC miscreants. Attacks are occurring most frequently in the districts of Bankura, Bardhman, West Midnapore, East Midnapore, and North 24 Parganas.

The AIDWA memorandum said, “A general deterioration in the law and order situation is only too apparent. When these attacks are accompanied by comments made by those at the highest level of political and police administration casting aspersions on complainants for hatching a conspiracy against the government, these anti-socials are likely to be emboldened and the course of justice subverted. No woman will dare to lodge a complaint in these circumstances.”  

In view of such a fast deteriorating situation, the AIDWA urged the NCW to send a team to West Bengal to investigate the cases and to make your recommendations to the highest authorities in the interest of justice for the women of West Bengal, as early as possible.

The delegation comprised AIDWA president Shyamali Gupta, vice president Subhashini Ali, general secretary Sudha Sundararaman and treasurer Banani Biswas.

The NCW chairperson, Smt Mamta Sharma, gave the delegation a patient and sympathetic hearing and assured the members that the commission would send an enquiry committee to West Bengal before the end of the month.
